  • In California, yes, consent is required by both parents in almost all cases unless one parent has been given sole custody, there are protective issues or other extreme, mitigating circumstances.
  • In Colorado, when parents are divorced, either parent can generally consent to mental health treatment for their minor child, unless a court order specifies otherwise. This is true even if both parents have joint legal decision making authority (legal custody).
  • In Delaware, yes, consent is required by both parents in almost all cases unless one parent has been given sole custody, there are protective issues or other extreme, mitigating circumstances.
  • In Florida, when parents have shared parental responsibility, either parent can consent to their child's mental health treatment, even after a divorce, unless the parenting plan explicitly states otherwise. This means one parent's consent is sufficient for mental health treatment.
  • In Massachusetts, yes, consent is required by both parents in almost all cases unless one parent has been given sole custody, there are protective issues or other extreme, mitigating circumstances.
  • In New York, yes, consent is required by both parents in almost all cases unless one parent has been given sole custody, there are protective issues or other extreme, mitigating circumstances.
